A lawsuit for damages arising out of negligence or intentional conduct causing death is known as an action for wrongful death. If a person is injured as a result of a negligent or wrongful act, that person can file a lawsuit and collect damages for their injuries. Prior to the wrongful death statute being enacted, any cause of action died with the individual who was injured. The Michigan Wrongful Death Act allows the dead individual's estate to file a lawsuit on behalf of the deceased individual for the benefit of the survivors.

Michigan law provides a statute of limitation of three years after the time of the death or injury for all actions to recover damages for the death of a person, or for the injuries to a person or property.

Wrongful death statute provides for compensation of lost wages that the individual would have earned in the future. In addition to lost earnings, damages can include loss of companionship and consortium.
