CHILD SUPPORT LAW IN MICHIGAN


Child support is determined by the Michigan Child Support Guidelines.  Child Support guidelines are up-dated periodically to take into consideration cost of living, inflation, and other economic conditions. These guidelines calculate support based on a mathematical formula. The formula considers a number of different factors when calculate support.  

The primary factors are:

  • The income of the noncustodial parent
  • The income of the custodial parent,
  • The number of children
  • number of overnights of each party.
  • The amount of day-care necessary to raise the child.

 The amount support is not necessarily increased on a dollar for dollar increase in the payor's income. The court may also look towards a party's ability to work when calculate support. This most often happens when one party is intentionally not working in order to increase or decrease their child support.

A person may change the amount of support by showing that there has been a change in circumstances that would change the amount of support that is recommended by the child support guidelines. In event that one of the parties is remarried, income of the new spouse will not be considered in the calculation child support.

Typically, child support will amount to approximately 30 percent of party’s net income for two children. This amount can increase or decrease depending on the number of children and the day-care expenses involved.

Support can be modified by filing a requested with the Circuit Court or Friend of the Court. In a requested to modify support you must state the change in circumstances that would warrant a change in support pursuant to the guidelines.

After calculating the child support amount, you should contact an attorney to file a motion to modify child support. Typically, an attorney will charge between 500 - 1000 dollars.
